  • Restricting supplier or contributor access
  • Ending relationships with suppliers or content providers
  • Taking other reasonable steps to reduce legal or intellectual property risk

3. How to Submit a DMCA Takedown Notice

If you are a copyright owner or authorized to act on behalf of one and believe material available on Merch Collect infringes your copyright, you may send us a written copyright infringement notice.

To allow us to properly review your notice, please include the following information:

  1. Identification of the copyrighted work. Clearly identify the copyrighted work you claim has been infringed. If your claim involves multiple copyrighted works, you may provide a representative list where appropriate.

Notices that are incomplete, unclear, or do not provide sufficient information to locate the reported material may require additional information and may take longer to review.

4. What Happens After We Receive a Copyright Notice

After receiving a copyright infringement notice, we may:

  1. Review the notice for completeness and validity.
  2. Request additional information from the complainant where necessary.
  3. Remove, disable, or restrict access to the reported material where appropriate.
  4. Notify the relevant supplier, designer, contributor, user, partner, or other content source where appropriate.
  5. Provide information regarding a counter-notification process where applicable.
  6. Take action regarding repeated or serious infringement where appropriate.

Where appropriate or required by law, we may forward some or all of a copyright complaint, including identifying or contact information, to the person or entity responsible for the reported material.

5. Counter Notification

If material you provided was removed or disabled because of a copyright complaint and you believe the removal resulted from mistake or misidentification, you may submit a written counter notification where applicable under the DMCA.

A counter notification should include:

  1. Your physical or electronic signature.
  2. Identification of the removed material. Identify the material that was removed or disabled and the location where it appeared before removal or disabling.
  3. Statement under penalty of perjury. State that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
  4. Your contact information. Provide your name, address, telephone number, and email address.
  5. Consent to jurisdiction and service of process. Include the jurisdiction and service-of-process statements required by applicable DMCA law.

6. Restoration Following a Counter Notification

If an applicable and valid counter notification is received, it may be provided to the original complainant.

Under the applicable DMCA process, removed material may be restored no sooner than 10 business days and generally no later than 14 business days after receipt of a valid counter notification, unless the original complainant informs the service provider that they have filed a court action seeking to restrain the allegedly infringing activity.

Restoration is not automatic in every situation and may also depend on applicable law, platform requirements, contractual obligations, or other legal considerations.

7. Misrepresentations

Copyright notices and counter notifications should only be submitted when the sender has a good-faith basis for the statements made.

Under 17 U.S.C. §512(f), a person who knowingly materially misrepresents that material or activity is infringing, or that material was removed or disabled by mistake or misidentification, may be liable for damages as provided by law.

10. Suppliers, Designers, and Third-Party Content

Merch Collect may work with suppliers, designers, production partners, fulfillment providers, licensors, or other third parties.

If a valid copyright concern relates to third-party supplied content, we may contact the relevant party, suspend the affected product, request proof of authorization, or take other appropriate action.

11. Repeat Infringer Policy

Merch Collect may take reasonable action regarding suppliers, contributors, users, or other content sources that are repeatedly associated with valid copyright infringement complaints.

Depending on the circumstances, such action may include:

  • Removing content
  • Disabling products
  • Suspending listings
  • Restricting access
  • Ending supplier or contributor relationships

12. No Admission of Liability

Removal or restriction of content in response to a copyright complaint does not necessarily constitute an admission that Merch Collect or any other party has infringed intellectual property rights.

Merch Collect may temporarily remove or restrict content while reviewing a claim in order to reduce potential legal or business risk.
