- The exact URL of the product or page

Design Similarity and Style Claims
A general similarity in artistic style, theme, color, concept, genre, or subject matter does not always mean that intellectual property rights have been infringed.
When reviewing design-related complaints, we may consider the specific protected elements involved, the evidence provided, applicable law, and whether the complainant has established ownership or enforceable rights.
How We Review Intellectual Property Complaints
When we receive an intellectual property complaint, we may:
- Review the submitted claim and supporting materials
- Temporarily remove or disable access to the content
- Remove or suspend a product listing
- Contact the designer, supplier, production partner, or other party involved
- Request additional information from the complainant
- Request evidence of ownership or authorization
- Take other action we believe is reasonably appropriate
We aim to review clear and complete claims as reasonably quickly as possible.
Incomplete, unclear, unsupported, or highly complex claims may require additional time.
Removal of Content
Merch Collect reserves the right to remove, disable, suspend, or restrict access to any product, design, image, or other content where we believe there may be a legitimate intellectual property concern, legal risk, customer confusion, policy violation, or business risk.
Removal of content does not necessarily mean that Merch Collect accepts liability or agrees with every allegation made in a complaint.
Counter Notices
If content has been removed or disabled because of an intellectual property complaint and you believe the removal resulted from a mistake, misidentification, valid authorization, license, or other lawful use, you may contact us with a counter notice.
A counter notice should include:
- Your full legal name or company name
- Your email address and contact information
- The URL or description of the removed content
- A clear explanation of why you believe the content was removed by mistake or misidentification
- Any evidence of authorization, license, ownership, or lawful use
- A statement that the information in your counter notice is accurate
- Your physical or electronic signature
Where appropriate or legally required, we may share relevant counter-notice information with the original complainant.
We may also require additional information before restoring any content.
Repeat or Serious Infringement
Merch Collect may remove content, disable products, suspend listings, stop working with suppliers or contributors, restrict accounts, or take other appropriate action when repeat or serious intellectual property issues are identified.
We reserve the right to remove any product or content where we believe continued publication may create legal, trademark, copyright, customer confusion, platform, payment provider, or business risk.
Suppliers, Designers, and Content Contributors
Where Merch Collect works with third-party designers, suppliers, production partners, contributors, or licensors, those parties are expected to provide only content they own, control, license, or have permission to use.
We may request evidence of ownership, permission, authorization, or licensing where reasonably necessary.
We may suspend or discontinue working with a supplier, designer, or contributor where serious or repeated intellectual property concerns arise.
False, Misleading, or Abusive Claims
Please submit an intellectual property complaint only if you have a good-faith belief that your rights are being infringed.
False, fraudulent, misleading, abusive, incomplete, or intentionally inaccurate claims may delay the review process and may result in legal responsibility where applicable.
Submitting a complaint does not automatically establish that infringement has occurred.
Customer and User Submissions
If you submit photographs, reviews, comments, artwork, designs, testimonials, videos, or other content to Merch Collect, you represent that you own the content or have the necessary rights and permissions to share it.
You must not submit content that infringes another person's copyright, trademark, privacy, publicity, or other legal rights.
By submitting content to us, you grant Merch Collect a non-exclusive, worldwide, royalty-free license to use, display, reproduce, edit, adapt, publish, and share that content for:
- Customer support
- Store operations
- Website display
- Product reviews
- Marketing
- Advertising
- Promotional purposes
This license applies only to the extent permitted by applicable law and the terms under which the content was submitted.
DMCA and Other Legal Procedures
Where applicable, copyright complaints may also be handled in accordance with relevant copyright laws, including the Digital Millennium Copyright Act or other applicable legal procedures.
Nothing in this policy limits any rights or obligations that apply under applicable law.
No Legal Determination
Merch Collect is not a court and does not make binding legal determinations regarding ownership, validity, or infringement of intellectual property rights.
Our review process is intended to help us manage content on our website and respond reasonably to intellectual property concerns.
Disputes that cannot be resolved through our internal review process may need to be resolved directly between the relevant parties or through appropriate legal procedures.
